Abortion in Mẹ́ksíkò
Information about abortion access and services in Mẹ́ksíkò.
Is abortion in Mexico legal?
Yes, abortion is legal in many states up to 12 weeks of pregnancy, with some states allowing a few weeks more or less, and it is allowed nationwide in cases such as rape or risk to the pregnant person's life. Abortion in Mexico became legally protected after a landmark Supreme Court ruling in September 2021 that declared the total criminalization of abortion unconstitutional. Since then, 23 states have reformed their penal codes to allow abortion up to 12 weeks of pregnancy (with some variations, such as Sinaloa allowing it up to 13 weeks and Aguascalientes up to 6 weeks). In these states, pregnant people can access safe, free, and legal abortion services through the public health system within the legal timeframe. In all Mexican states, abortion is permitted without penalty in specific circumstances such as rape, as established by NOM-046 [3], risk to the life or health of the pregnant person, accidental or negligent causes, severe fetal impairment, and pregnancy from non-consensual artificial insemination. Some states also include additional exceptions such as economic reasons or denial of information by authorities.
