Is abortion legal in Bolivia?
Abortion in Bolivia is not legal on request, but it is permitted under specific circumstances such as rape, incest, or when the pregnancy poses a risk to the pregnant person's health or life. Abortion in Bolivia is not available on request. However, it is permitted under certain legal grounds established in the Penal Code and reaffirmed by Constitutional Ruling 0206/2014. A Legal Interruption of Pregnancy (ILE) is allowed when the pregnancy is the result of rape, incest, or statutory rape; when the pregnant person is a minor or a student; or when the pregnancy poses a risk to their physical, mental, or social health, or their life.To access abortion in cases of sexual violence, the person must present a copy of the official complaint and give informed consent. In cases of risk to health or life, or when there are lethal congenital malformations, a medical report and informed consent are required. There is no specific gestational limit established by law for these situations. However, in practice, first-level public health centers may only offer the procedure during the first trimester, and later-term abortions are referred to higher-level facilities. Despite this legal framework, many still face obstacles to access.
