Is abortion legal in Costa Rica?
Under the Penal Code (Article 121), abortion is permitted to save a pregnant person’s life or health (mental and/or physical), with their consent and performed by a licensed physician. However, implementation is severely restricted in practice due to the absence of regulatory guidelines and widespread institutional resistance.In January 2025, the government introduced a bill proposing tougher penalties, up to 6 years for the person seeking abortion and up to 12 years for providers. This legislative effort reflects an increasingly conservative approach and has raised concerns among health and human rights experts about further criminalization of reproductive care [4].
